OFFICIAL RULES

HOW TO ENTER: Fill out official entry form in its entirety by sweepstakes entry deadline.

AGREEMENT TO OFFICIAL RULES: Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and (the decisions of the Sponsor, which are final and binding. Winning a Prize is contingent upon fulfilling all requirements set forth herein.

ENTRY PERIOD: The Sweepstakes Entry Period begins on November 17, 2015 at 12:00AM and ends on November 23 at 11:59PM.  Entries received after this end time will not be considered.

ENTRY: Limit one (1) entry per Facebook account during the sweepstakes period.

ELIGIBILITY: Participants must be at least 18 years of age at the time of entry. Participation is subject to all federal, state, and local laws and regulations. Void in Puerto Rico and where prohibited by law.

SPONSOR: The Sweepstakes is sponsored by Midwest Pantry. This contest is in no way sponsored or administered by Facebook. The information you provide will only be used for this contest’s purposes.

DRAWING:  The Sweepstakes Drawing will be on or before November 24, 2016. The names of the potential Winner(s) will be picked in a random drawing of all eligible entries received.

REQUIREMENTS OF THE POTENTIAL WINNERS: Midwest Pantry will notify potential Winner immediately.  Potential Winner pick do not need to be present at the time of the Drawing to accept the Prize.  If a potential Winner does not respond within 24 hours of the Drawing, or if a potential Winner declines to accept the Prize, Midwest Pantry will forfeit the prize and no prize will be awarded.

Except where prohibited by law, Winners are required to complete and return an Affidavit of Eligibility, Publicity and Liability Release Form (the “Affidavit/Release”) after being notified of winning and before claiming their Prize.  If a potential Winner fails to sign and return the Affidavit/Release within the required time period, an alternate entrant will be selected in his/her place in a random drawing of all entries received.  By entering the Drawing, Winners agree to participate in any associated publicity. (Winners must furnish proof of identity, address and birth date to claim the Prize)

PRIZES:  The first qualified name drawn will receive a Gift Basket with goods from Local MWI Merchants with a(n) (approximate) retail value of $250.00. Any giveaway with a value of $600 or more must be reported (by the Winner) to the IRS.  Therefore Midwest Pantry must not only make entrants aware of the value of the Prize, but also that they will need to complete an Affidavit/Release, as well as be responsible for any taxes that may result from winning. ) The odds of being selected depend on the number of eligible Entries received during the Entry Period.  Midwest Pantry accepts no responsibility for any costs associated with travel and lodging as this must be provided by the winner if it is outside of the “local” resident area to Midwest Pantry. The prize has no cash value and is non-transferable.  Limit one (1) Prize per person.

PUBLICITY: Each Winner may be required to pose for a digital photograph. (except where this requirement is prohibited by law). Participation in the Sweepstakes constitutes Winner’s consent to Midwest Pantry use of Winner’s name, likeness, picture, and state of residence for promotional, publicity, and/or advertising purposes worldwide in any media and on the World Wide Web, in perpetuity, without further payment consideration, review, or consent (where allowable). Participant names and information will not be sold or given to a third party.

DISPUTES: Except where prohibited by law, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any Prize awarded shall be resolved individually without resort to any form of class action, and exclusively by the appropriate court located in the State of Minnesota. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules (whether of the  or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Minnesota.  In the event of an error, howsoever caused, whether a printing error or otherwise, and whether obvious or otherwise, which affects the Drawing in any way, Midwest Pantry, in its sole discretion, reserves the right to administer the Drawing as though the error had not occurred. Where Midwest Pantry deems it appropriate and/or feasible, it will notify entrants of the error and put forth a correction.

RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Sweepstakes, entrants agree to release and hold Midwest Pantry harmless from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any Prize including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property which may be caused directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt of any Prize. Entrant further agrees that in any cause of action,

Midwest Pantry liability will be limited to the entrant’s cost of entering and participating in the Sweepstakes, and in no event shall Midwest Pantry be liable for attorneys’ fees.  Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect.

GENERAL CONDITIONS: In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, Midwest Pantry may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the Prizes at random from among the eligible entries received. Midwest Pantry reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Midwest Pantry reserves the right to seek damages from any such person to the fullest extent permitted by law. Midwest Pantry failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In case of a dispute as to the ownership of an entry, entry will be deemed to have been submitted by the authorized account holder/resident entrant of the property at which the Drawing is held.
